| 505 | 0 | |a This is a revised version of the book "The World Bank Inspection Panel" (report no. 13719) detailing the mechanisms and possible effects of the Panel on the operations of the Bank, with texts of relevant documents. While the first edition had the advantage of analyzing the Resolution that established the Panel, it obviously could not reflect on the experience of the Panel. This book, therefore expands on the practical application of the Resolution, and elaborates on questions previously hypothesized. The author reviews the evolution of an independent inspection function in World Bank operations, the motives conducive to this inspection function, and studies the Resolution as applied in practice through project cases inspected thus far. He describes the provisions of the Resolution as "living phenomena ..." potentially influenced by ad hoc application practices; a legal observation that proved relevant to the constituent instrument of the Inspection Panel. Operational remedial actions that followed, though unintentionally preemptive, precluded full practice of the Resolution as felt by the Panel. This, and other factors called for a revision of the Resolution, which resulted in a return to the original Resolution, found to provide the alternatives required for the investigation process. This edition provides detailed descriptions of the Board reviews, analyzing the impact of the Panel on the evolution of international law, and policy. -- Provided by publisher. | |
